AT&T Wireless

I was and believe still am an AT&T customer but with this merger with
Cingular my phone a V600 now says Cingular as opposed to AT&T.

My question is this, as a consumer what are my rights? I signed up a
contract with AT&T but now have Cingular.

No matter what they call it, there is no more AT&T Wireless. Cingular bought
it and you are now a Cingular customer. Your contract was and is most
likely with "AT&T Wireless Services, its assigns and successors," which
means they have the right to assign or transfer your contract to whomever
they please. Your rights as a consumer? Assuming you have any that are
enforceable, you can fulfill your contract or pay an early termination fee
to get out of it. If you're past the contract period then you're free to
switch to another carrier and keep your number.

Why does this bother you? You get to keep the same rate plan, or migrate to a
Cingular plan at low cost. You have greatly expanded mobile-to-mobile
calling. You have free roaming on the entire Cingular network. Is the name
displayed on your phone so important?

The phone is AT&T with and Cingular software.

What bothers me is that they can do anything they want to us such as selling
themselves and we have to accept new carrier but if we wanted or tried going
to some other carrier we would have to pay the penalty.

They can do whatever they want in accordance to what you agreed to when you
signed the contract. If you didn't like the terms you shouldn't have signed
it. You could have just bought a prepaid card and not had a contract. True,
they give you better rates and a better discount on the phone if you sign a
contract but that's the bargain you make for doing it.
To Cingular/ATT's credit, from what I understand, they will still honor the
terms of the original contract with respect to rate plans and features and,
at the same time, allow you to switch to a different Cingular plan if you
prefer. Seems that the only thing that's changed is the name. AT&T has
always had the option of changing their name - company's do it all the time,
particularly in the Telecom biz.

brobin relax, I just asked a question about my rights as a costumer.
If you bought a Porsche to find out later you had a BMW engine in it, it
seems it would be fine w/you because you signed on the dotted line.
I think we should not have to go along and be sold as phone companies, banks
and so on desire. My opinion

As a roamer on Cingular in 2004, I found they billed me for listening to a
ringing tone - which I was not billed for when roaming on AT&T. If
Cingular do that sort of billing to their own customers, surely that will
also impact those ex-AT&T people who were used to being billed from when
the phone was answered....

I'm quite relaxed, thanks - particularly after the chocolate martini before
dinner. No, if I bought a Porsche and found a BMW engine in it, it would NOT
be OK with me but that's beside the point. Your analogy is flawed in that
there was no "bait and switch" or substitution of another company's product.
The ATT product became the Cingular product. While I understand that some
people are resistant to any change, companies are bought, sold and merged
all the time - it's called free enterprise. If the new entity fails to honor
the terms of your contract you can claim a breach and sue for damages,
specific performance or relief from your obligations.

Just a side note: the car thing happens all the time. Not Porsche to BMW
per se, but some BMW's had GM transmissions. Volvo diesels had VW engines.
Kia uses Toyota parts. Ford 5-speed by Mazda, etc.
I'm also AT&T (family plan) and my phone still says AT&T Wireless while my
wife's says Cingular. Who cares.
