ATTWS Porting Fee?

I recently switched from ATTWS' Shared Plan (2 lines @ $59.99,
contract ended 9 Jan 04) to TMobile's Family Time 800 Plan (2 lines @
$69.99, started 19 Jan 04). I received my final invoice from ATTWS and
was noticed an "adjustment" of $17.99 per phone line, totalling
$35.98. This is called a "Monthly Service Charge." Isn't this really a
penalty charge for porting the number to TMobile? Are they sore
losers? Also, what if I had ported to Cingular? I really don't intend
to pay that fee, as my contract was over. Has anyone else seen this?

When I ported, I got a similar charge, but it was (IIRC) simply the pro-rated
amount I owed for service for the final billing cycle. Beyond that, which I
rightly owed, I was not charged an additional fee.

If your case is similar, I'd guess you fairly owe them the charge. Without
knowing your file, though, I'd be hard to say.

ATTWS does not charge to port out. That amount was a "pro-rated" amount for
the last month's service - basically you pay for only the days you were on
service until the end of your billing cycle. The only way you would be
charged a fee would be if you broke your contract with ATTWS to port out to
another carrier. In that case you would be charge an Early Termination Fee
of $175.00.

If you have any further concerns regarding the final bill, contact Customer
Care.

I finally got through to CC. Here are the answers I received:

1- Troy (no#, I forgot to ask): It is the pro-rated charge for the
partial month.
Note: I was also charged the pro-rated amount of $28.53US
2- Lisa (#83059): The charge is for leaving/porting out ten days into
a billing cycle.
3- Gene Eljen (no #, said he had no employee #/Manager): Confirmed
what Lisa stated. Stated that it was ATTWS policy. I requested a copy
of that policy.

Has anyone else been hit for this charge? Is it a legit charge or just
sour grapes?

All 3 are basically the same answer. It's a legit charge. And trust me,
I'd rather not see AT&T get anyone's money.
